Is membership in the Homeowners Association optional?
Membership in the Homeowners Association is mandatory. When the City of Marengo approved the subdivision of this property a homeowners association was established.
Does the Homeowners Association have an annual fee?
Yes, the Homeowners Association dues are established by the Board of Directors each year and a bill is sent to each resident the following January.

Does the Homeowners Association have meetings?

Yes, by law the Homeowners Association is required to hold at least four meetings per calendar year. We do not have regularly scheduled meetings, however we have tried to keep them pretty close to quarterly. The meetings are usually held at 7:00 PM in Marengo City Hall Council Chambers.

 
Does the Homeowners Association have a set of rules?
Yes, the Homeowners Association has a set of covenants which are posted on this website. 
How does the Homeowners Association enforce the covenants?
The Homeowners Association enforces the covenants through a request which is sent to the homeowner in violation. If a resolution is not obtained or is not possible, the association has the ability to place liens on violators' property.
I'm interested in repainting or making a modification/addition to my property, what are the procedures?
There are different sets of rules depending on the scope of the project. In order to do a minor alteration or repair (less than $2,500.00) a person would merely need to obtain a building permit from the City of Marengo, if one is required. If the modification is in excess of $2,500.00 then a review by the Architectural Review Board is required. In essence it is probably best to contact any member of the Homeowners Association Board prior to start of the project and we can advise if the repair/modification is permitted and how to proceed.
If I get a building permit from the city, do I still need approval from the Homeowners Association?
Yes, the City of Marengo can and will issue a permit for things that are in conflict with our covenants. A prime example is fence height. The City's Ordinance allows a fence to a maximum height of 6' whereas the association covenants only allows a maximum height of 3'-6". The city is not bound nor can they enforce our covenants therefore they are required to issue the permit. This does not however, mean that the person is necessarily allowed to under the Homeowners Association covenants. A valid permit from the City can still constitute a violation under the covenants, therefore as suggested above, it would be a good idea to contact one of the Board members before applying for permits or signing any contracts for work.
If the Homeowners Association approves the modification for my neighbor, can I assume that the same modification will be approved for me?
No, because each case is considered on a case by case basis. If the same modification is requested it will likely be approved however it is not safe to assume.
I believe a violation of the covenants is taking place, what do i do?
If you see a violation and would like to report it, you can contact any member of the Homeowners Association Board of Directors. 
Who do I contact regarding concerns in the community?
If you have concerns in the community that are outside the scope of the Homeowners Association, a person should contact the City of Marengo (815) 568-7112 or other service having jurisdiction.
How can I get a copy of the Covenants, Conditions, & Restrictions?
The covenants and restrictions are available on the website. If someone does not have access to the internet, a copy can be requested from any member of the Board of Directors and copies of the appropriate documents can be made. 
Can the covenants be changed?
Yes, A proposal would need to be brought forward by an individual or group in the subdivision. The individual requesting the change should canvass all property owners within the subdivision along with the proposed change. In order for a language change to occur, an affirmative vote by at least 75% of all homeowners must be obtained in order for the covenant to be amended.
How does the Homeowners Association spend dues money?
The Homeowners Association dues are allocated to different funds, including landscaping (mowing), maintenance of association lands, legal fees, postage expenses and various other items which are listed in the budget. A copy of the budget can be obtained by contacting any Board member. 
I can't make it to a meeting, how can I vote?
A homeowner can vote one of two ways if unable to make the meeting. First, a ballot can be mailed to the Homeowners Association at P.O. Box 82 Marengo, IL 60152. Secondly, a proxy can vote at the meeting so long as the appropriate proxy form and ballot are completed prior to the meeting. 
How can I help?
The best way that any resident can help the association is to show up at the meetings! In order to have your opinions heard it is important to attend the meetings and provide input. Also if you cannot attend a meeting it is also appropriate to contact any member of the Board either through e-mail or phone to discuss your issue.
